3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

3.1. Age Requirements

MyTalent is intended for users who are at least 16 years of age. If you are under 16, you may not create an account or use the service, and we do not knowingly collect personal information from individuals under 16.

By creating an account, you represent and warrant that you are at least 16 years of age. If we learn that an account has been created by someone under 16, we will take steps to remove the account and delete the associated personal information in accordance with our Privacy Policy.

4. User Content

By posting content, you grant MY TALENT INC. a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your content on the Service for the purpose of operating and promoting the Service. You are solely responsible for the content you post, and your content must comply with our community guidelines and applicable law. We use automated systems, including AI-based moderation, to detect and prevent prohibited content, and we may remove, restrict, or refuse to publish content that violates these Terms or our community guidelines, with or without prior notice. You may not use MyTalent:

• In any way that violates any applicable law or regulation

6. Rewards, Points, and Earnings

MyTalent operates a reward system where users can earn points through various activities, such as posting content, engaging with the community, and referring new users. Points and achievements have no cash value unless and until they are redeemed in accordance with our redemption policies, which we may update from time to time.

Eligible creators may receive monetary rewards or payouts based on their activity and performance on the platform. Eligibility, calculation, and timing of payouts are determined by MyTalent and may be subject to additional requirements such as identity verification, tax documentation, and compliance with these Terms. We reserve the right to modify, suspend, or terminate the reward system or any monetisation feature at any time.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. You may also terminate your account at any time through your account settings or by contacting us. Upon termination, your access to the service will cease, and we will handle your personal data in accordance with our Privacy Policy, including your rights to access, deletion, and portability under applicable data protection laws.

The materials on MyTalent are provided on an 'as is' basis. MY TALENT INC. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Limitation of Liability

In no event shall MY TALENT INC. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on MyTalent. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection laws.

10. Changes to Terms

We may revise these Terms from time to time. For material changes we will notify you at least 30 days before they take effect, by email and through an in-app notice. For changes that affect processing based on your consent (for example, marketing communications), we will request your fresh consent before applying the change. 11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms or the use of MyTalent shall be subject to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware, USA. Notwithstanding the foregoing, if you reside in the European Economic Area, the United Kingdom, or any other jurisdiction whose mandatory consumer protection laws give you the right to bring proceedings in your country of residence, those rights are not affected by this clause. Nothing in these Terms limits your statutory rights as a consumer that cannot be waived under applicable law.
